Are Kane County Court Records Public?

Yes. Under the Court Record and Document Accessibility Act (705 ILCS 86), court records are public by default. This means that Kane County court records are open for public inspection and copying. However, records are equally subject to court discretion and local court rules, as well as other state laws or statutes that may mark certain information as confidential. Per 705 ILCS 86, non-public records are categorised into impounded, confidential, sealed, and expunged records; with each having distinct meanings and implications.

For instance, impounded records are only accessible to case parties. Otherwise, they may only be released to a requester by a court order. If a requested record is non-public and the court clerk or other designated record custodian has to withhold access, the said record custodian must notify the requester of the reason. What Information is Available in Kane County Court Records?

Typical Kane County court records contain the following information categories of information:

  • Online Access - Online court record searches in Kane County are performed using the Smart Search portal. Searches require a name or case number. While name-based searches only require the last, first and middle name (in that format) of a case party, a person only needs to type in the case number for case-number searches. Searches on this platform are free.
  • In-Person Access - the Kane County Circuit Clerk’s Office handles all court record requests. Fees for Court Records in Kane County

According to the Circuit Court’s fee schedule, the following fees are assessed for copies of Kane County court records:

  • $2.00 for the first page, $0.50 for the second to twentieth page, and $0.25 for subsequent pages.
  • $6.00 for summary page printout
  • $6.00 search fee per searched name or year

Criminal Records Access in Kane County

Under the Uniform Conviction Information Act (UCIA), Kane County criminal records (specifically conviction information) are public. Kane County criminal records are maintained by the office of the circuit clerk and are accessible to interested county residents. To inspect these records, visit the Kane County Circuit Clerk’s Office or use the Smart Search portal. The clerk’s office is open to visitors Monday through Friday, 8:30 A.M. to 4:30 P.M. Note that records available at the clerk’s office are typically limited to court-related information.

For a more comprehensive criminal history, a criminal background check is recommended. The Illinois State Police, Bureau of Identification, is responsible for processing criminal background checks. This agency provides online access to criminal records through name-based and fingerprint-based searches. Name-based searches are done using the CHIRP (Criminal History Information Response Process) portal. Users must register an account to perform a search.

For a fingerprint-based search, the services of a live scan fingerprint vendor is required. If the needed record is required for licensing, employment, etc., it is best to contact the Bureau of Identification to obtain important information needed for the live scan and for further instructions.

Kane County Probate Records

The Kane County probate court sits in the Kane County Courthouse complex. Probate matters handled by this court include estate administrations, conservatorships, will administration, guardianships, trust administrations, and mental health proceedings. Probate filings are handled by this court and include estate records, death certificates, wills, inventory of assets, and settlement agreements.

Most probate court records are available online. Note that older records may not be found on this website. In addition, certain cases are confidential and associated records are unavailable online. To obtain records not found online, interested persons should contact the office of the circuit clerk. Information required during a search is mainly the first and last names of the record subject and the case number.

Confidential probate records are only available to case parties and persons authorized by a court order. Eligible individuals must visit the courthouse in person with a valid means of identification.

Kane County Family Court Records

The Family Division of the Kane County Circuit Court presides over family law cases, such as divorces, child support, adoption, child custody, paternity, spousal support, and name change cases. Although assumed public, access to family court records are highly regulated due to the sensitive nature of some cases handled by this court, such as adoption and juvenile delinquency records.
